HUNTSVILLE, Ala. (WHNT) – The family of Jaden Coppens, the 10-year-old girl who died in a wreck last May in south Huntsville, has filed a civil lawsuit in the case.
The complaint, filed January 17, names Gunner Scarano and his father, Richard Scarano as defendants.
The Coppens were hit at the intersection of Bailey Cove Road and Weatherly Road on May 28, 2013. Police say Gunner Scarano was driving the truck that hit their vehicle, along with several other cars.
Jaden Coppens died from her injuries. Her mother, Andrea Coppens, was injured, along with daughters Journey and Jasmine. In all, seven people were hurt in various vehicles.
The lawsuit claims negligence on the part of Gunner Scarano, and on the part of his father, Richard, for entrusting him with the vehicle. Friday, Madison County District Attorney Rob Broussard confirmed Scarano’s toxicology reports came back clean, and that he would not face criminal charges in the wreck. The case was presented to a Madison County grand jury, who came back with a ‘no bill’.
The complaint says the plaintiffs are seeking $350,000 in damages.
